1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Make Tiny Desk AI ("we", "us", or "our", accessible at https://maketinydeskai.com). By visiting our website, creating an account, uploading a photo, or generating an AI video, you expressly agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must discontinue using our services immediately.

2. Service Description & AI Video Generation

Make Tiny Desk AI provides an online generative artificial intelligence tool that turns a single portrait photo into a vertical (9:16) AI concert video inspired by iconic intimate desk musical performances.

  • AI Inference Pipeline — Video generation utilizes advanced AI inference pipelines and secure cloud storage.
  • Probabilistic Nature of AI — Video outputs are synthetically generated. Facial nuances, lighting, micro-expressions, background desk elements, and performance gestures may vary. You acknowledge that AI output cannot guarantee a 1:1 photorealistic match in every scenario.
  • Service Evolution — We reserve the right to optimize models, refine generation parameters, and adjust platform features with reasonable notice.

3. User Eligibility & Portrait Rights

  • Age Requirement — You must be at least 18 years old to access and use our generation features.
  • Strict Likeness Authorization — You represent and warrant that any photo you upload is either of yourself or an adult who has granted you explicit written authorization to use their likeness for AI video generation.
  • Prohibited Persons — Uploading images of minors, children, non-consenting individuals, or public figures without legal authorization is strictly prohibited.
  • Account Security — You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Credits, Pricing, and Refunds

  • Credits Metering — Video generation costs credits based on resolution: 480P costs 5 credits, 720P costs 10 credits (default), and 1080P costs 20 credits per 15-second video.
  • Deduction and Automatic Failure Return — When you initiate video generation, the required credits (5, 10, or 20 credits) are reserved. If a generation task encounters an unrecoverable system failure or error, the reserved credits are automatically restored to your account balance immediately.
  • One-Time Credit Packs — One-time credit packs do not expire and remain active in your account until used.
  • Payment Refunds vs. Credit Returns — Automatic credit return restores your digital balance upon generation errors. Real-currency payment refunds for credit packs are governed by our Refund Policy.

5. Intellectual Property & Acceptable Use Policy

  • Uploaded Content — You retain all ownership rights in your uploaded portrait photos. You grant us a limited, worldwide license solely to process, render, host, and deliver your requested video outputs.
  • Acceptable Use Standards — You agree not to upload photos or generate content containing:
    1. Pornography, nudity, sexually explicit or suggestive material.
    2. Depictions of violence, weapons, gore, hate speech, or harassment.
    3. Child sexual abuse material (CSAM) — zero-tolerance immediate ban and reporting.
    4. Non-consensual deepfakes, identity theft, or impersonation.
    5. Content that infringes any third-party intellectual property or privacy rights.
  • Independent Project Disclaimer — Make Tiny Desk AI is an independent creative parody and entertainment application. It is not affiliated with, sponsored by, authorized by, or endorsed by NPR (National Public Radio), Tiny Desk Concerts, or any artists or record labels.

6. Disclaimer of Warranties & Limitation of Liability

The platform and AI generation services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. To the maximum extent permitted by law, Make Tiny Desk AI and its operators shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the service.
